1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of Pingta (the "App"), provided by Heapstack LLC ("we", "us", "our"). By accessing or using the App, you agree to these Terms and our Privacy Policy.
2. Description of the App
Pingta is a network diagnostic tool for iOS that provides functionality including but not limited to: ping monitoring, traceroute, speed testing, DNS lookup, LAN scanning, port scanning, and Whois lookups. The App is provided free of charge.
3. Permitted Use
You may use Pingta only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App to perform unauthorized network scanning or probing of systems you do not own or have explicit permission to test.
- Use the App to violate any applicable local, national, or international laws or regulations.
- Attempt to reverse-engineer, decompile, or disassemble any portion of the App.
- Use the App in any way that could damage, disable, or impair servers or networks.
- Use automated means to interact with the App in a way that circumvents its intended purpose.
4. Responsible Use of Network Tools
Important: Network scanning and diagnostic features (e.g., port scanner, LAN scanner, traceroute) must only be used on networks and systems you own or have explicit, documented permission to test. Unauthorized scanning of systems may violate the Computer Fraud and Abuse Act (CFAA), the EU Network and Information Security Directive, and equivalent laws in other jurisdictions. Heapstack LLC assumes no liability for unauthorized use.
5. Intellectual Property
The App and its original content, features, and functionality are and will remain the exclusive property of Heapstack LLC and its licensors. Our trademarks may not be used in connection with any product or service without the prior written consent of Heapstack LLC.
6. Third-Party Services
The App may interact with third-party services such as public DNS resolvers, speed test servers, or WHOIS databases. These services are operated independently and governed by their own terms. We make no warranty regarding the availability or accuracy of third-party services.
7. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that defects will be corrected.
8. Limitation of Liability
To the maximum extent permitted by law, Heapstack LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.
In no event shall our total aggregate liability to you exceed the amount you paid for the App (which is zero for a free app).
9. Indemnification
You agree to indemnify and hold harmless Heapstack LLC and its officers, employees, and agents from any claims, damages, expenses, and liabilities arising from your use of the App, violation of these Terms, or violation of any rights of a third party.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will indicate the date of last revision at the top of this page. Your continued use of the App after any changes constitutes acceptance of the new Terms.
